Terms and conditions of service

GENERAL INFORMATION

The end-user who accepts these terms and conditions (hereinafter also "Buyer") expressly declares that they are making the purchase for purposes unrelated to their commercial or professional activity. Once the online purchase procedure has been completed, the buyer will be required to print or save an electronic copy of these sales conditions, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on distance sales. Each purchase operation will be governed by this contract (hereinafter also "Contract"), in accordance with the provisions of Legislative Decree 185/99, Legislative Decree 206/05 and Legislative Decree 21/2014. The information aimed at concluding the contract will be subject to article 12 of Legislative Decree 70/03 and, regarding data privacy, all information relating to the contract and the parties will be subject to the legislation set out in Legislative Decree 196/03.

SUPPLIER IDENTIFICATION

The goods covered by these general conditions are offered for sale on the portal www.danielademarchi.it, by ddm Srl, with registered office in Via dei Piatti 9, 20123 Milan (MI), P.IVA 06722440960, e-mail web@danielademarchi.it.

DEFINITIONS

The term "online sales contract" refers to the contract stipulated between the Supplier and the Buyer, concerning the sale of movable tangible goods available to the Supplier within a distance selling system through electronic means, organized by the Supplier itself. The term "Buyer" refers to the consumer, a natural person making the purchase, as per the Contract, for purposes not related to any commercial or professional activity performed. The term "Supplier" refers to the entity specified above or the entity providing information services (for example, regarding the processing of personal data).

SUBJECT OF THE CONTRACT

With this contract, the Supplier sells and the Buyer remotely purchases, via electronic means, the movable tangible goods indicated and offered for sale on the website www.danielademarchi.it. The goods and services for sale are those described on the portal www.danielademarchi.it. The data indicated therein may be subject to periodic changes and/or updates, also with the aim of further improving the service.

METHOD OF ENTERING INTO THE CONTRACT

The contract between the Supplier and the Buyer is concluded exclusively via the internet by the Buyer accessing the web address www.danielademarchi.it, after which the Buyer, following the indicated procedures, will formalize the proposal for the purchase of the goods referred to in clause 4.1. The buyer will purchase the products present in the electronic catalog on the website www.danielademarchi.it as described in the respective information sheets. It is generally understood that ddm srl, in any case, cannot guarantee the exact correspondence to reality in relation to the images and colors as they appear on the monitor.

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

Before the Buyer sends their consent to purchase, a web screen will open containing a summary sheet illustrating the price of the purchased good, shipping costs and any additional accessory charges, payment methods and terms, and the address where the good will be delivered. As soon as the Supplier receives the order from the Buyer, they will send a confirmation email to the address indicated by the Buyer, containing all the data present in the summary sheet referred to in clause 6.1. In case of non-acceptance of the order, the buyer will be promptly notified.

DELIVERY TIMES AND METHODS

  • SHIPPING

Production times for ordered products are 7 working days from receipt of the order. If the item is immediately available, it will be shipped on the same day or the next working day after the order was placed, subject to confirmation of merchandise availability and successful payment for the chosen item. If multiple items are ordered, shipping times will follow those of the item with the longest lead time, unless separate orders are placed. ddm srl will deliver the selected and ordered goods using the TNT carrier. All items we ship are carefully packaged and protected to prevent damage during transit. For orders with destination Italy, ddm srl offers a free standard shipping service for orders over 150 euros. For orders below this amount, the shipping cost will be 10 euros. For shipments outside Italy, please contact our customer service via email web@danielademarchi.it. For destinations within the European Union, shipping is free for orders over 300 euros; otherwise, costs range from €20 to €40 depending on the country of delivery. For non-EU countries, shipping ranges from €20 to €40 depending on the destination country, plus any customs duties or other export fees. Shipping costs are charged at the time of payment on the total order. The carrier is not authorized to request payments. Deliveries in Italy take 1/2 working days from when the carrier takes charge. For deliveries to Basilicata, Calabria, Campania, Puglia, and the islands, an additional 1 or 2 days are required. ddm srl is not responsible for any delays due to the carrier. ddm srl disclaims responsibility for any delays due to force majeure, strikes, or natural disasters. Upon delivery of the goods by the courier, the buyer is required to check:

  • that the number of packages delivered matches what is indicated in the email containing the order number sent by web@danielademarchi.it
  • that the packaging is intact, not damaged, wet, or otherwise altered, including the sealing materials of the packaging (e.g., adhesive tape).

Any damage to the packaging and/or product or discrepancy in the number of packages must be immediately contested by writing "acceptance with reservation", specifying the reason for the reservation (e.g., crushed packaging), on the courier's delivery receipt. After signing the courier's document, the buyer cannot make any claims regarding the external condition of what was delivered. Any issues concerning the physical integrity, conformity, or completeness of the received products must be reported within 3 days of delivery via email to web@danielademarchi.it.

  • PICK-UP AT THE DDM STORE

Collection can also be made at one of our single-brand stores. During the purchase process, select: Pick-up at Atelier - Via dei Piatti or Pick-up at Boutique - p.le Lavater. An email will be sent as soon as the order is available for collection at the selected store. Collection at the store is free. You will need to present the confirmation email, in paper or digital format, and an identity document. If the person collecting the order is different from the person who purchased it, they must show written authorization and a photocopy of the identity document of the person who made the purchase.

Gift packaging

Each item is packaged in a voile pouch, a small box with ribbon, and a shopper bag. If you wish to make a special gift, you can write us a message, and we will include a card with your words in the package.

PRICES

All selling prices of goods displayed and indicated on the www.danielademarchi.it portal are expressed in euros and constitute a public offer pursuant to art. 1336 of the Italian Civil Code. The selling prices, as per the previous clause, include VAT and any other taxes, with the exception of any customs duties. Shipping costs, if present, are indicated and calculated both in the purchase procedure before the order is forwarded by the buyer and in the confirmation email. The Supplier will not be responsible for any taxes, duties, and/or other customs duties or those related to the individual regulatory systems of the States, for which only and exclusively the Buyer will be responsible (as already specified in point 8). Prices may be subject to variations based on any promotions.

PAYMENT METHODS

Our dshop accepts the following payment methods:

  • CREDIT CARD

Visa, MasterCard, reloadable credit cards enabled. The amount will be charged to the card upon order confirmation.

  • PAYPAL

To shop online conveniently, without needing to enter credit card details on the website. The account is charged upon order completion. To register a new PayPal account, visit paypal.com. In the event that merchandise is purchased using a credit card, ddm Srl never comes into possession of the buyer's card information at any point in the purchase process. The transmission of payment information occurs via the highest security standard. Under no circumstances can ddm Srl be held responsible for any fraudulent and improper use of credit cards by third parties when paying for products purchased on www.danielademarchi.it.

AVAILABILITY OF GOODS

Although availability may be stated on the website, ddm Srl does not guarantee immediate shipment or availability of products in all cases and reserves the right to contact the Buyer to communicate any order cancellation in case of problems. In case of order cancellation, the refund will be issued within 48 working hours using the same method used for payment.

LIMITATIONS OF LIABILITY

The Supplier assumes no responsibility in the event of failure to execute the order within the times provided by the contract due to unforeseen circumstances or force majeure. The Supplier cannot be held liable to the Buyer, except in cases of willful misconduct or gross negligence, if it is unable to fulfill the Contract due to service disruptions or malfunctions related to the use of the internet network beyond its control. The Supplier assumes no responsibility for any fraudulent and unlawful use by third parties of credit cards, checks, and other means of payment, at the time of payment for purchased goods, if it demonstrates that it has adopted all possible precautions based on the best science and experience of the moment and based on ordinary diligence. The Supplier assumes no responsibility for any damages attributable to the carrier.

BUYER'S OBLIGATIONS

The Buyer undertakes to pay the price of the purchased good within the times and in the manner indicated in the Contract. The Buyer undertakes, once the online purchase procedure is completed, to print and keep a copy of the Contract. The information contained in the Contract has, moreover, already been viewed and accepted by the Buyer before purchase confirmation.

RIGHT OF WITHDRAWAL

  • Pursuant to Art. 5 D.L. 185/1999, the Buyer has the right to withdraw from the stipulated contract, without any penalty, within 14 working days, starting from the day on which they come into possession of the purchased good. The right of withdrawal applies to undamaged merchandise including its original box, complete in all its parts.
  • Shipping costs related to the return of the goods are borne by the customer.
  • ddm Srl is in no way responsible for damage or theft/loss of goods returned with uninsured shipments.
  • Without prejudice to any costs for restoring damage ascertained to the original packaging, ddm Srl will refund the buyer the full amount already paid (excluding original shipping costs), within 30 days of accepting the returned merchandise. The right of withdrawal is totally forfeited due to the lack of the essential condition of the integrity of the good, in cases where the use of the good is ascertained, the lack of the original inner packaging, or damage to the product due to causes other than its transport.

EXERCISING THE RIGHT OF WITHDRAWAL

To exercise the right of withdrawal, it is necessary to inform ddm srl and initiate a return process by sending an email to: web@danielademarchi.it. The communication relating to the exercise of the right of withdrawal must be sent by the User before the expiry of the withdrawal period. For the purpose of the burden of proof relating to the exercise of the right of withdrawal within the indicated terms, it is in the buyer's interest to use a durable medium when communicating their withdrawal to ddm srl.

CONDITIONS OF THE RIGHT OF WITHDRAWAL

  • The buyer will take care of the shipment of the returned products complete with original packaging and packing, as well as any accessories and gifts received with the product.
  • The buyer must take care of all products, as long as they are in their possession.
  • Once the integrity of the returned product has been verified, ddm srl will refund the entire amount paid for the returned products.
  • As provided for by art. 59 of the Consumer Code, the right of withdrawal does not apply to custom-made or clearly personalized goods. In such cases, ddm products made exclusively for the user with the requested artisanal personalization that have been ordered and delivered are not subject to the right of withdrawal and cannot be collected and refunded by ddm.

RETURNS AND REFUNDS

ddm srl protects its customers and allows returns for any product within 14 days from the delivery date. The return policy does not apply to custom-made or clearly personalized goods. All orders completed and received between December 1st and December 22nd can be returned until January 8th. For orders delivered after December 22nd, regular return times apply.

HOW TO REQUEST A RETURN:

Send an email to web@danielademarchi.it with the return request indicating:

  • name and surname of the person who made the purchase
  • the order number

Make sure the products are in the same condition as when they were received. Jewelry must not have been worn but only tried on. An email will be sent with the return form to be completed and sent back to web@danielademarchi.it.

RETURN VIA COURIER:

  • Package the merchandise, including a copy of the completed return form inside the package.
  • Place the products in their original packaging: the products must be returned in the same condition in which they were received, meaning in perfect state of preservation, unused, complete with all their elements, provided with any attached manuals, labels, and tags still attached to the product. Returned items will be taken into custody and checked to ascertain that they have been returned intact.

If the return does not meet the listed conditions, the package will be returned and no refund will be issued. The possibility of making a return is granted only once per order, so make sure to include all items you intend to return in the return bag.

  • Ship the package to the following address:

  • Keep the shipping receipt.

IN-STORE RETURN:

It is possible to return items purchased on the danielademarchi.it website at our single-brand stores within 14 days.

  • Place the products in their original packaging: the products must be returned in the same condition in which they were received, meaning in perfect state of preservation, unused, complete with all their elements, provided with any attached manuals, labels, and tags still attached to the product. Returned items will be taken into custody and checked to ascertain that they have been returned intact.
  • Go to one of the following stores and make the return:

WHAT HAPPENS NEXT:

Usually, returns are accepted within 3 working days from the delivery of the package to the warehouse. During peak times, it may take up to 7 working days. After acceptance, we will immediately process the refund and send a confirmation email. The refund is issued using the same method used for payment. The refund will be equal to the amount of the purchased item(s), excluding any shipping costs paid. The timing of refunds for due amounts depends exclusively on PayPal and/or the banking system.

COMMUNICATIONS AND COMPLAINTS

Written communications sent to the Supplier and any complaints will only be considered valid if sent to the following address: ddm Srl, via dei Piatti 9, 20123 Milan (MI) or sent via e-mail to the following address web@danielademarchi.it The Buyer indicates their residence or domicile, telephone number or email address to which they wish to receive communications from the Supplier in the request form.

APPLICABLE LAW AND REFERENCES

This contract is governed by Italian law and any dispute will be resolved by the court of Milan. For anything not expressly provided herein, the applicable legal provisions for the relationships and circumstances contemplated in this contract apply, and in particular Article 5 of the Rome Convention of 1980. Pursuant to Article 60 of the Consumer Code, the regulations contained in Part III, Title III, Chapter I - Consumer Code are expressly referenced herein.

FINAL CLAUSE

This Agreement supersedes and replaces any prior agreement, understanding, negotiation, written or oral, entered into between the parties concerning the subject matter of this contract.
