INFORMAZIONI GENERALI

L’utente finale che accetta i presenti termini e condizioni (di seguito anche “Acquirente”) dichiara espressamente di compiere l’acquisto per fini estranei all’attività commerciale o professionale esercitata. Una volta conclusa la procedura di acquisto online, l’acquirente sarà tenuto a stampare o salvare copia elettronica delle presenti condizioni di vendita, nel rispetto di quanto previsto dagli artt. 3 e 4 del D.lgs. 185/1999 sulle vendite a distanza. Ogni operazione di acquisto sarà regolata dal presente contratto (di seguito anche “Contratto”), in conformità alle disposizioni di cui al D.Lgs. 185/99, al D.Lgs. 206/05 e al D.Lgs. 21/2014. Le informazioni dirette alla conclusione del contratto saranno sottoposte all’art. 12 del D.Lgs. 70/03 e, per quanto concerne la tutela della riservatezza, ogni informazione inerente al contratto e alle parti sarà sottoposta alla normativa di cui al D.Lgs. 196/03.

IDENTIFICAZIONE DEL FORNITORE

I beni oggetto delle presenti condizioni generali sono posti in vendita sul portale www.danielademarchi.it,  da ddm Srl, con sede in Via dei Piatti 9, 20123 Milano (MI), P.IVA 06722440960, e-mail web@danielademarchi.it.

DEFINIZIONI

Con l’espressione “contratto di vendita online”, s’intende il contratto, stipulato tra il Fornitore e l’Acquirente, avente per oggetto la compravendita dei beni mobili materiali nella disponibilità del Fornitore nell’ambito di un sistema di vendita a distanza tramite strumenti telematici, organizzato dal Fornitore stesso. Con l’espressione “Acquirente” si intende il consumatore, persona fisica che compie l’acquisto, di cui al Contratto, per scopi non riferibili all’attività commerciale o professionale eventualmente svolta. Con l’espressione “Fornitore” si intende il soggetto indicato in epigrafe ovvero il soggetto prestatore dei servizi di informazione (ad esempio riguardanti il trattamento dei dati personali).

OGGETTO DEL CONTRATTO

Con il presente contratto, rispettivamente, il Fornitore vende e l’Acquirente acquista a distanza tramite strumenti telematici i beni mobili materiali indicati e offerti in vendita sul sito www.danielademarchi.it. I beni e i servizi in vendita sono quelli descritti sul portale www.danielademarchi.it. I dati ivi indicati possono essere soggetti a modifiche e/o aggiornamenti periodici, anche allo scopo di un ulteriore miglioramento del servizio.

MODALITÀ DI STIPULAZIONE DEL CONTRATTO

Il contratto tra il Fornitore e l’Acquirente si conclude esclusivamente attraverso la rete internet mediante l’accesso dell’Acquirente all’indirizzo web www.danielademarchi.it, a seguito del quale l’Acquirente, seguendo le procedure indicate, formalizzerà la proposta per l’acquisto dei beni di cui alla clausola 4.1. L’acquirente acquisterà i prodotti presenti nel catalogo elettronico presente sul sito www.danielademarchi.it così come descritti nelle relative schede informative. Resta inteso generico che ddm srl, in ogni caso, non è in grado di garantire l’esatta corrispondenza alla realtà in relazione alle immagini ed ai colori come appaiono sul monitor.

CONCLUSIONE ED EFFICACIA DEL CONTRATTO

Prima dell’invio del consenso all’acquisto da parte dell’Acquirente, verrà aperta una schermata web contenente una scheda riepilogativa in cui verranno illustrati il prezzo del bene acquistato, le spese di spedizione e gli eventuali ulteriori oneri accessori, le modalità e i termini di pagamento e l’indirizzo ove il bene verrà consegnato. Nel momento in cui il Fornitore riceve l’ordine dall’Acquirente, provvede all’invio di una e-mail di conferma all’indirizzo indicato dall’Acquirente, contenente tutti i dati presenti nella scheda riepilogativa di cui alla clausola 6.1. Nel caso di mancata accettazione dell’ordine sarà data tempestiva comunicazione all’acquirente.

TEMPI E MODALITÀ DI CONSEGNA

• SPEDIZIONE

I tempi di realizzazione dei prodotti ordinati sono di 7 gg lavorativi a partire dalla ricezione dell’ordine. Se l’oggetto è disponibile subito, viene spedito lo stesso giorno o il primo giorno feriale successivo a quello in cui è stato effettuato l’ordine, previa conferma della disponibilità della merce e dell’avvenuto pagamento dell’articolo prescelto. Qualora si ordinassero più articoli, i tempi di spedizione seguiranno quelli dell’articolo con tempistiche più lunghe, a meno che non si facciano singoli ordini. La ddm srl provvederà a recapitare i beni selezionati e ordinati tramite l’uso del trasportatore TNT. Tutti gli oggetti che spediamo sono imballati e protetti con cura per evitare che arrivino danneggiati. Per gli ordini con destinazione Italia, la ddm srl mette a disposizione un servizio di spedizione standard gratuita per ordini superiori a 150 euro. Per gli ordini di importo inferiore, il costo della spedizione sarà di 10 euro. Per spedizioni fuori dall’Italia, contattare il nostro servizio clienti tramite mail web@danielademarchi.it. Per le destinazioni in Unione europea, la spedizione è gratuita per ordini superiori ai 300 euro, altrimenti i costi variano dai 20€ ai 40€ a seconda del paese di consegna. Per i Paesi extra cee, la spedizione varia dai 20€ ai 40€ a seconda del paese di destinazione più le eventuali tasse doganali o altre spese di esportazione. Il costo di spedizione viene addebitato al momento del pagamento sul totale dell’ordine. Il trasportatore non è tenuto a richiedere pagamenti. Le consegne in Italia avvengono in 1/2 giorni lavorativi dalla presa in carico del trasportatore. Per la consegna in Basilicata, Calabria, Campania, Puglia e isole, sono richiesti 1 o 2 giorni aggiuntivi. La ddm srl non è responsabile di eventuali ritardi dovuti al trasportatore. La ddm srl si esonera da eventuali ritardi dovuti a cause di forza maggiore, scioperi o calamità naturali. Al momento della consegna della merce da parte del corriere, l’acquirente è tenuto a controllare:

• che il numero dei colli in consegna corrisponda a quanto indicato nella mail contenente il numero d’ordine inviata da web@danielademarchi.it

• che l’imballo risulti integro, non danneggiato, bagnato o comunque alterato, anche nei materiali di chiusura dell’imballo (es. nastro adesivo).

Eventuali danni all’imballo e/o al prodotto o la mancata corrispondenza dei colli devono essere immediatamente contestati, apponendo una scritta, “accettazione con riserva”, specificando il motivo della riserva (es. imballo schiacciato), sulla prova di consegna del corriere. Dopo aver apposto la firma sul documento del corriere, l’acquirente non potrà opporre alcuna contestazione circa le condizioni esteriori di quanto consegnato. Eventuali problemi inerenti l’integrità fisica, la corrispondenza o la completezza dei prodotti ricevuti dovranno essere comunicati entro 3 giorni dall’avvenuta consegna via mail all’indirizzo web@danielademarchi.it. 

• RITIRO PRESSO IL PUNTO VENDITA DDM

Il ritiro può essere effettuato anche presso uno dei nostri punti vendita monomarca. Durante il processo di acquisto selezionare: Ritiro in Atelier -Via dei Piatti oppure Ritiro in Boutique – p.le Lavater. Sarà inviata un’email non appena l’ordine sarà disponibile per il ritiro presso il punto vendita selezionato. Il ritiro presso il punto vendita è gratuito. Sarà necessario presentarsi con l’email di conferma, in forma cartacea o digitale e un documento di identità. Se la persona che si reca a ritirare l’ordine è diversa da quella che lo ha acquistato, dovrà esibire un’autorizzazione scritta e una fotocopia del documento di identità della persona che ha effettuato l’acquisto.

Confezione regalo

Ogni articolo è confezionato in una bustina di voile, una scatolina con nastro e una shopper. Se desideri fare un regalo speciale puoi scriverci una frase e inseriremo nel pacco un biglietto con le tue parole.

PREZZI

Tutti i prezzi di vendita dei beni esposti e indicati all’interno del portale www.danielademarchi.it sono espressi in euro e costituiscono offerta al pubblico ai sensi dell’art. 1336 c.c. I prezzi di vendita, di cui alla clausola precedente, sono comprensivi di IVA e di ogni eventuale altra imposta, eccettuati gli eventuali oneri doganali. I costi di spedizione, se presenti, sono indicati e calcolati sia nella procedura di acquisto prima dell’inoltro dell’ordine da parte dell’acquirente, sia nell’e-mail di conferma. Il Fornitore non si farà carico di eventuali tasse, imposte e/o altri tributi doganali o legati ai singoli sistemi normativi degli Stati, di cui risponderà solo ed esclusivamente l’Acquirente (come già specificato nel punto 8). I prezzi possono essere soggetti a variazioni in funzione di eventuali promozioni.

MODALITÀ DI PAGAMENTO

Il nostro dshop accetta i seguenti metodi di pagamento:

• CARTA DI CREDITO 

Visa, MasterCard, carte di credito ricaricabili abilitate.  L’importo verrà addebitato sulla carta al momento della conferma dell’ordine. 

• PAYPAL

Per acquistare online comodamente, senza bisogno di digitare sul sito i dati della carta di credito. L’addebito sul conto avviene al completamento dell’ordine. Per registrare un nuovo conto PayPal, visita il sito paypal.com. Nel caso in cui si acquisti la merce tramite carta di credito, in nessun momento della procedura di acquisto ddm Srl entra in possesso delle informazioni relative alla carta dell’acquirente. La trasmissione delle informazioni di pagamento avviene tramite lo standard di sicurezza più elevato. In nessun caso ddm Srl potrà essere ritenuta responsabile per un eventuale uso fraudolento e indebito di carte di credito da parte di terzi, all’atto del pagamento di prodotti acquistati su www.danielademarchi.it

DISPONIBILITÀ DEI BENI

Nonostante ne possa essere espressa la disponibilità sul sito, ddm Srl non garantisce in tutti i casi l’immediata spedizione o disponibilità dei prodotti e si riserva di poter contattare l’Acquirente per comunicare l’eventuale annullamento dell’ordine in caso di problematiche. In caso di annullamento dell’ordine, il rimborso verrà emesso entro 48 ore lavorative tramite la stessa modalità utilizzata per il pagamento.

LIMITAZIONI DI RESPONSABILITÀ

Il Fornitore non assume alcuna responsabilità, nel caso non riesca a dare esecuzione all’ordine nei tempi previsti dal contratto per caso fortuito o causa di forza maggiore. Il Fornitore non potrà ritenersi responsabile verso l’Acquirente, salvo il caso di dolo o colpa grave, nel caso in cui non sia in grado di adempiere al Contratto a causa di disservizi o malfunzionamenti connessi all’utilizzo della rete internet al di fuori del controllo. Il Fornitore non assume alcuna responsabilità per l’eventuale uso fraudolento e illecito da parte di terzi, delle carte di credito, assegni e altri mezzi di pagamento, all’atto del pagamento dei beni acquistati, qualora dimostri di aver adottato tutte le cautele possibili in base alla miglior scienza ed esperienza del momento e in base alla ordinaria diligenza. Il Fornitore non assume alcuna responsabilità per eventuali danni imputabili al trasportatore.

OBBLIGHI DELL’ACQUIRENTE

L’Acquirente si obbliga a pagare il prezzo del bene acquistato nei tempi e modi indicati dal Contratto. L’Acquirente si obbliga, una volta conclusa la procedura d’acquisto online, a provvedere alla stampa e alla conservazione del Contratto. Le informazioni contenute nel Contratto sono state, peraltro, già visionate e accettate dall’Acquirente prima della conferma di acquisto.

DIRITTO DI RECESSO

• Ai sensi dell’art. 5 D.L. 185/1999, l’Acquirente ha il diritto di recedere dal contratto stipulato, senza alcuna penalità, entro il termine di 14 giorni lavorativi, decorrente dal giorno in cui entra in possesso del bene acquistato. Il diritto di recesso si applica alla merce integra comprensiva della sua scatola originale, completa in tutte le sue parti.

• Le spese di spedizione relative alla restituzione del bene sono a carico del cliente

• ddm Srl non risponde in nessun modo per danneggiamenti o furto/smarrimento di merci restituite con spedizioni non assicurate.

• Fatte salve eventuali spese per il ripristino di danni accertati all’imballo originale, ddm Srl provvederà a rimborsare all’acquirente l’intero importo già pagato (ad esclusione delle spese di spedizione originarie), entro 30 giorni dall’accettazione del reso merce. Il diritto di recesso decade totalmente per mancanza della condizione essenziale di integrità del bene, nei casi in cui si accerti l’utilizzo del bene, la mancanza dell’imballo interno originale o per il danneggiamento del prodotto per cause diverse dal suo trasporto.

ESERCIZIO DEL DIRITTO DI RECESSO

Per esercitare il diritto di recesso occorre informare ddm srl e avviare una pratica di reso inviando una email a: web@danielademarchi.it. La comunicazione relativa all’esercizio del diritto di recesso deve essere inviata dall’Utente prima della scadenza del periodo di recesso. Ai fini dell’onere della prova relativa all’esercizio del diritto di recesso nei termini indicati è nell’interesse dell’acquirente avvalersi di un supporto durevole quando comunica il proprio recesso a ddm srl.

CONDIZIONI DEL DIRITTO DI RECESSO

• L’acquirente si occuperà della spedizione dei prodotti resi completi di confezioni e imballo originali, nonché di ogni accessorio e omaggio ricevuto con il prodotto.
• L’acquirente deve prendersi cura di tutti i prodotti, finché questi sono in suo possesso.
• Una volta verificata l’integrità del prodotto restituito, ddm srl provvederà a rimborsare l’intero importo pagato per i prodotti resi.
• Così come previsto dall’art. 59 del Codice del Consumo, il diritto di recesso non si applica ai beni confezionati su misura o chiaramente personalizzati. In tal caso i prodotti ddm realizzati esclusivamente per l’utente con la personalizzazione artigianale richiesta che siano stati ordinati e consegnati non sono soggetti al diritto di recesso e non possono essere ritirati e rimborsati dalla ddm.

RESI E RIMBORSI

La ddm srl tutela i propri clienti e consente il reso per qualsiasi prodotto entro 14 giorni dalla data di consegna. Il reso non si applica ai beni confezionati su misura o chiaramente personalizzati. Tutti gli ordini completati e ricevuti tra il 1 e il 22 dicembre potranno essere resi fino all’8 gennaio. Per ordini consegnati dopo il 22 dicembre, si applicano i tempi di reso regolari.

COME RICHIEDERE IL RESO:

Inviare una mail a web@danielademarchi.it con la richiesta di reso indicando:

• nome e cognome di chi ha effettuato l’acquisto
• il numero d’ordine

Assicurarsi che i prodotti siano nelle stesse condizioni in cui sono stati ricevuti. I gioielli non devono essere stati indossati ma solo provati. Verrà inviata una mail con il modulo di reso da compilare e rimandare all’indirizzo web@danielademarchi.it.

RESO TRAMITE CORRIERE:

• Impacchettare la merce inserendo nel pacco una copia del modulo di reso compilato.

• Inserire i prodotti nell’imballaggio originale: i prodotti dovranno essere restituiti nelle stesse condizioni in cui sono stati ricevuti e cioè in perfetto stato di conservazione, inutilizzati, completi di tutti i loro elementi, provvisti di eventuali manuali allegati, etichette e cartellini ancora attaccati al prodotto. Gli articoli resi verranno presi in consegna e controllati per constatare che gli stessi siano stati restituiti intatti.

Se il reso non soddisfa le condizioni elencate, il pacco verrà rispedito e il rimborso non sarà effettuato. La possibilità di effettuare il reso viene concessa una sola volta per ogni ordine, assicurarsi quindi di aver inserito nella busta di reso tutti gli oggetti che si intendono rendere.

RESO IN NEGOZIO:

E’ possibile restituire gli articoli acquistati sul sito danielademarchi.it anche presso i nostri punti vendita monomarca entro 14 giorni.

• Inserire i prodotti nell’imballaggio originale: i prodotti dovranno essere restituiti nelle stesse condizioni in cui sono stati ricevuti e cioè in perfetto stato di conservazione, inutilizzati, completi di tutti i loro elementi, provvisti di eventuali manuali allegati, etichette e cartellini ancora attaccati al prodotto. Gli articoli resi verranno presi in consegna e controllati per constatare che gli stessi siano stati restituiti intatti.

• Recarsi presso uno dei seguenti punti vendita ed effettuare il reso:

COSA SUCCEDE DOPO:

Solitamente il reso è accettato entro 3 giorni lavorativi dalla consegna del pacco al magazzino. In momenti di picco possono volerci fino a 7 giorni lavorativi. Dopo l’accettazione richiederemo immediatamente il rimborso e invieremo un’email di conferma. Il rimborso viene emesso tramite lo stesso metodo utilizzato per il pagamento. Il rimborso sarà pari all’importo dell’articolo/i acquistato/i, ad esclusione delle eventuali spese di spedizione pagate. I tempi di rimborso delle somme dovute dipendono esclusivamente da Paypal e/o dal sistema bancario.

COMUNICAZIONI E RECLAMI

Le comunicazioni scritte dirette al Fornitore e gli eventuali reclami saranno ritenuti validi unicamente ove inviati al seguente indirizzo: ddm Srl, via dei Piatti 9, 20123 Milano (MI) oppure inviati a mezzo e-mail al seguente indirizzo web@danielademarchi.it L’Acquirente indica nel modulo di richiesta la propria residenza o domicilio, il numero telefonico o l’indirizzo di posta elettronica al quale desidera siano inviate le comunicazioni del Fornitore.

LEGGE APPLICABILE E RINVIO

Il presente contratto è regolato dalla legge italiana e ogni eventuale controversia verrà risolta presso il foro di Milano. Per quanto qui non espressamente disposto valgono le norme di legge applicabili ai rapporti e alle fattispecie previste nel presente contratto, e in particolar modo l’art. 5 della Convenzione di Roma del 1980. Ai sensi dell’art. 60 del Codice del consumo, viene qui espressamente richiamata la disciplina contenuta nella Parte III, Titolo III, Capo I -Codice del Consumo.

CLAUSOLA FINALE

Il presente Contratto abroga e sostituisce ogni accordo, intesa, negoziazione, scritta od orale, intervenuta in precedenza tra le parti e concernente l’oggetto di questo contratto.

 

 

GENERAL INFORMATIONS

IDENTIFICATION OF THE SUPPLIER 

The goods subject to these general conditions are offered for sale on the portal www.danielademarchi.it , by ddm Srl, with headquarters in Via dei Piatti 9, 20123 Milan (MI), VAT number 06722440960, e-mail web @ danielademarchi.it . 

DEFINITIONS

1. The term “online sales contract” means the contract stipulated between the Supplier and the Purchaser, having as its object the purchase and sale of tangible movable goods available to the Supplier in the context of a remote sales system through telematic tools, organized by the Supplier itself.
2. The term “Buyer” means the consumer, a natural person who makes the purchase, as per the Contract, for purposes not related to any commercial or professional activity carried out.
3. The expression “Supplier” means the person indicated in the epigraph or the person providing the information services (for example concerning the processing of personal data).

OBJECT OF THE CONTRACT

1. With this contract, respectively, the Supplier sells and the Purchaser remotely purchases the movable tangible goods indicated and offered for sale on the website danielademarchi.itvia telematic tools .
2. The goods and services for sale are those described on the portal danielademarchi.it. The data indicated therein may be subject to periodic changes and / or updates, also for the purpose of further improving the service.

METHOD OF SIGNING UP THE CONTRACT 

The contract between the Supplier and the Buyer is concluded exclusively through the internet through the Buyer’s access to the web address www.danielademarchi.it, following which the Buyer, following the procedures indicated, will formalize the proposal for the purchase of the goods referred to in clause 4.1 . The buyer will purchase the products present in the electronic catalog on the website www.danielademarchi.it as described in the relevant information sheets. It is generally understood that ddm srl , in any case, is not able to guarantee the exact correspondence to reality in relation to the images and colors as they appear on the monitor. 

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

1. Before the Buyer’s consent to purchase is sent, a web screen will open containing a summary sheet in which the price of the purchased good, the shipping costs and any additional accessory charges, the methods and terms of payment and the address where the goods will be delivered.
2. When the Supplier receives the order from the Buyer, it sends a confirmation e-mail to the address indicated by the Buyer, containing all the data present in the summary sheet referred to in clause 6.1.
3. In case of non-acceptance of the order, timely notice will be given to the buyer.

TIME AND METHOD D The DELIVERY SHIPMENT 

The production times of the ordered products are 7 working days from the receipt of the order. If the item is available immediately, it is shipped the same day or the first working day following the one on which the order was placed, subject to confirmation of the availability of the goods and payment of the chosen item. If you order more items , the shipping times will follow that of the article with longer times, unless you make single orders. The ddm srl will deliver the goods selected and ordered through the use of the TNT carrier. All items we ship are carefully packaged and protected to prevent them from arriving damaged. For orders with destination Italy , ddm srl provides a free standard shipping service for orders over 150  euro. For orders of a lower amount, the cost of shipping will be 10 euros. For shipments outside Italy, contact our customer service by email web@danielademarchi.it. For and destinations in the European Union, the shipping is free for orders above 300 €, or the costs vary from 20 € to 40 € depending on the country. For extra cee , shipping varies from 20 € to 40 € depending on the country of destination plus any customs duties or other export expenses. The shipping cost is charged at the time of payment on the total order. The carrier is not required to request payments. Deliveries in Italy take place in 1/2 working days from taking charge of the carrier. For delivery in Basilicata, Calabria, Campania, Puglia and islands, 1 or 2 additional days are required. The ddm srl is not responsible for any delays due to the carrier. The ddm srl is exempt from any delays due to force majeure, strikes or natural disasters. Upon delivery of the goods by the courier, the buyer is required to check:

• that the number of packages delivered corresponds to what is indicated in the email containing the order number sent by web @ danielademarchi.it

• that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials of the packaging (eg adhesive tape).

Any damage to the packaging and / or the product or the mismatch of the packages must be immediately contested, by writing, “acceptance with reserve”, specifying the reason for the reservation (eg crushed packaging), on the courier’s proof of delivery. After having signed the courier’s document, the buyer will not be able to make any objection about the external conditions of what has been delivered. Any problems concerning the ‘ integrity physical, correspondence or completeness of the products received must be reported within 3 days of delivery by mail at web@danielademarchi.it .

COLLECTION AT THE POINT OF SALE DDM

The collection can also be made at one of our single-brand stores. During the purchase process select: Collection in the Atelier – Via dei Piatti or Collection in Boutique – p.le Lavater. An email will be sent as soon as the order is available for collection at the selected store. Collection at the point of sale is free. It will be necessary to show up with the confirmation email , in paper or digital form and an identity document. If the person who goes to collect the order is different from the one who bought it, he must show a written authorization and a photocopy of the identity document of the person who made the purchase. Gift box Each item is packaged in a voile bag, a box with ribbon and a shopper. PRICES

1. All the sale prices of the goods displayed and indicated on the portal www.danielademarchi.it are expressed in euros and constitute an offer to the public pursuant to art. 1336 cc
2. The sales prices, referred to in the previous clause, include VAT and any other tax, except for any customs duties.
3. The shipping costs, if any, are indicated and calculated in the purchase procedure before placing the order by the buyer and in the confirmation email.
4. The Supplier will not be responsible for any taxes, duties and / or other customs duties or taxes related to the individual regulatory systems of the States, for which the Buyer will be solely and exclusively responsible (as already specified in point 8).
5. Prices may be subject to changes depending on any promotions.

 

METHOD OF PAYMENT

Our e shop accepts the following payment methods:

• CREDIT CARD

Visa, MasterCard, rechargeable credit cards enabled. The amount will be charged to the card upon confirmation of the order.

• PAYPAL

To buy online conveniently, without having to enter your credit card details on the site. The account will be debited upon completion of the order. To register a new PayPal account, visit paypal.com . In the event that the goods are purchased by credit card , at no time during the purchase procedure does ddm Srl come into possession of the information relating to the buyer’s card. The transmission of payment information takes place via the highest security standard. In no case ddm Srl can be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment for products purchased on www.danielademarchi.it   

AVAILABILITY OF GOODS 

Although availability on the site may be expressed, ddm Srl does not guarantee in all cases the immediate shipment or availability of the products and reserves the right to contact the Buyer to communicate the possible cancellation of the order in case of problems. If the order is canceled, the refund will be issued within 48 business hours in the same way it was received. 

LIMITATIONS OF LIABILITY

1. The Supplier assumes no responsibility if he fails to execute the order within the time stipulated in the contract due to unforeseen circumstances or force majeure.
2. The Supplier cannot be held liable to the Purchaser, except in the case of willful misconduct or gross negligence, in the event that it is unable to fulfill the Contract due to inefficiencies or malfunctions connected to the use of the internet outside of its control. .
3. The Supplier assumes no responsibility for any fraudulent or illegal use by third parties, credit cards, checks and other means of payment, upon payment of the purchased goods, if he proves that he has adopted all possible precautions in based on the best science and experience of the moment and based on ordinary diligence.
4. The Supplier assumes no responsibility for any damage attributable to the carrier.

BUYER’S OBLIGATIONS

1. The Buyer undertakes to pay the price of the purchased goods within the times and methods indicated in the Contract.
2. The Purchaser undertakes, once the online purchase procedure has been completed, to print and keep the Contract.
3. The information contained in the Contract has, however, already been viewed and accepted by the Buyer before confirming the purchase.

RIGHT OF WITHDRAWAL

• Pursuant to art. 5 DL 185/1999, the Purchaser has the right to withdraw from the stipulated contract, without any penalty, within the term of 14 working days , starting from the day he takes possession of the purchased good. The right of withdrawal applies to intact goods including its original box, complete in all its parts.
• The shipping costs related to the return of the goods are charged to the customer
• ddm Srl is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
• Without prejudice to any costs for the restoration of damage to the original packaging, ddm Srl will refund the buyer the full amount already paid (excluding the original shipping costs), within 30 days from the acceptance of the returned goods. The right of withdrawal is totally lost due to lack of the essential condition of integrity of the asset, in cases where the use of the asset is ascertained, the lack of the original internal packaging or damage to the product for reasons other than its transport.

EXERCISE OF THE RIGHT OF WITHDRAWAL 

To exercise the right of withdrawal should be informed ddm srl and start a practice made by sending an email to: web@danielademarchi.it. The communication relating to the exercise of the right of withdrawal must be sent by the User before the expiry of the withdrawal period. For the purposes of the burden of proof relating to the exercise of the right of withdrawal within the terms indicated, it is in the interest of the buyer to use a durable medium when communicating its withdrawal to ddm srl. 

CONDITIONS OF THE RIGHT OF WITHDRAWAL

• Ddm srl will take care of the collection of the products that the buyer must have made available for collection, complete with original packaging and packaging, as well as any accessories and gifts received with the product.
• The buyer must take care of all products as long as they are in his possession.
• Once the integrity of the returned product has been verified, ddm srl will refund the full amount paid for the returned products .
• As required by art. 59 of the Consumer Code, the right of withdrawal does not apply to goods made to measure or clearly personalized. In this case, ddm products made exclusively for the user with the required artisanal customization that have been ordered and delivered are not subject to the right of withdrawal and cannot be collected and refunded by the ddm.

RETURNS AND REFUNDS 

The ddm srl protects its customers and allows the return of any product within 14 days from the delivery date. The return does not apply to goods made to measure or clearly personalized. All orders completed and received between December 1st and 22nd can be returned until January 8th. For orders delivered after December 22nd, regular return times apply. 

HOW TO REQUEST THE RETURN:

1. Send an email to web@danielademarchi.it with the returnrequest indicating:

– name and surname of the person who made the purchase – the order number

1. Make sure that the products are in the same condition in which they were received. The jewels must not have been worn but only tried on.

1. An email will be sent with the return form to be completed and sent back to web@danielademarchi.it.

  RETURN BY COURIER:

• Pack the goods by inserting a copy of the completed return form in the package.

• Insert the products in the original packaging: the products must be returned in the same condition in which they were received, i.e. in perfect condition, unused, complete with all their elements, with any attached manuals, labels and tags still attached to the product. The returned items will be taken over and checked to verify that they have been returned intact.

If the return does not meet the conditions listed, the package will be sent back and the refund will not be made. The possibility of returning is granted only once for each order, so make sure you have included all the items you intend to return in the return envelope.

• Keep the receipt of the shipment.

RETURN IN STORE: 

It is possible to return the items purchased on the danielademarchi.it website also at our single-brand stores within 14 days.

• Insert the products in the original packaging: the products must be returned in the same condition in which they were received, i.e. in perfect condition, unused, complete with all their elements, with any attached manuals, labels and tags still attached to the product. The returned items will be taken over and checked to verify that they have been returned intact.

• Go to one of the following points of sale and make the return:

WHAT HAPPENS AFTER: Returns are usually accepted within 3 working days of delivery of the package to the warehouse. At peak times it can take up to 7 business days. After acceptance we will immediately request a refund and send you a confirmation email . The refund is issued using the same method used for payment. The refund will be equal to the amount of the purchased item (s), excluding any shipping costs paid. The repayment times of the amounts due depend exclusively on Paypal and / or the banking system. 

COMMUNICATIONS AND COMPLAINTS

1. Written communications to the Supplier and any complaints will be considered valid

only if sent to the following address: ddm Srl, via dei Piatti 9, 20123 Milan (MI) or sent by e-mail to the following web address @ danielademarchi.it

1. The Purchaser indicates in the request form his residence or domicile, the telephone number or the e-mail address to which he wishes the Supplier’s communications to be sent.

APPLICABLE LAW AND REFERENCE

1. This contract is governed by Italian law and any dispute will be resolved at the Milan court.
2. Although not expressly provided herein, the provisions of law applicable to the relationships and cases envisaged in this contract are valid, and in particular art. 5 of the Rome Convention of 1980.
3. Pursuant to art. 60 of the Consumer Code, the discipline contained in Part III, Title III, Chapter I – Consumer Code is expressly referred to here.

FINAL CLAUSE 

This Agreement repeals and replaces any agreement, understanding, negotiation, written or oral, previously intervened between the parties and concerning the subject of this contract.
